Maji Moto Maasai Cultural Camp - T&C's
When making a booking with Maji Moto Maasai Cultural Camp / Nariku Travel Experiences you accept that you have read and understand all Terms and Conditions and agree to abide by them. The person signing the Tour Booking Form does so on behalf of all other persons mentioned on the form. We reserve the right to refuse any booking at our discretion.
1. CONTRACT
1.1 Your contract is with Nariku Travel Experiences of Berkeley, California, and is only binding when you receive written confirmation that the following conditions are met:
1.1.1 Nariku Travel Experiences Booking Form has been signed 1.1.2 Deposit has been paid
1.1.3 General Terms and Conditions have been signed
1.2 The payment of the deposit or any other payment constitutes agreement and consent to all provisions of the conditions and general information contained in the website, brochure or customized itineraries.
2. PAYMENTS
2.1 Deposit of 50% of tour cost & 100% of airfare is due to confirm booking. 2.2 Final payment is due 8 weeks before departure.
2.3 No client is permitted to begin an itinerary without payment in full. If the full amount is not received, Nariku Travel Experiences is entitled to treat the reservation as cancelled and subject to cancellation penalties, as determined solely by Nariku Travel Experiences. Late applicants may join the tour based on availability.
2.4 Published prices include a 5% discount for cash payments. Credit card payments would result in adjustment to final cost.
2.6 For changes made 60 days prior to departure, a $100 fee applies per booking. For changes 59 days or less, cancellation or change fees may apply.
3. CANCELLATION
3.1 Cancellations must be made in writing to Nariku Travel Experiences and signed by the person whose name and signature appears on the Booking Form. The following cancellation charges apply:
3.1.1 More than 60 days prior to travel: 20% of deposit paid plus any other unrecoverable costs
3.1.2 Between 21 and 59 days: 50% of total trip cost plus any other unrecoverable costs
3.1.3 Less than 21 days: 100% of total trip cost
We strongly advise you to take suitable insurance to cover potential losses. 3.2 There is no refund for unused portions of a tour once it has commenced. 3.3 Some activities, such as Gorilla Tracking Permits,are nonrefundable.
3.4 Cancellation or rebooking of air reservations are subject to airline Terms & Conditions. Once issued, changes to name, date, routing or cancellation of ticket are subject to penalties as determined by the carrier, in addition to additional booking fees from Nariku Travel Experiences.
3.5 Nariku Travel Experiences will notify you as soon as practicable when it is affected by a Force Majeure. Nariku Travel Experiences shall not be deemed in breach of your Booking for these conditions or otherwise be liable to you for delay in performance, or by nonperformance of any of its obligations that are due to any Force Majeure.
If Nariku Travel Experiences is affected by Force Majeure it shall be entitled on its sole discretion to cancel or vary any arrangements or itinerary in relation to your Booking. Payment of any refund by Nariku Travel Experiences as a result of the non- performance of any of its obligations shall remain its sole and absolute discretion, with use of its reasonable endeavors to reimburse you where possible.
“Force Majeure” means any circumstances beyond reasonable control (including, but without limitation, war or threat of war, sabotage, civil disturbance, or requisition, acts of God, fire, accident, flood or explosion, sickness, quarantine, Government intervention, weather conditions or other untoward occurrences.
4. TOUR PRICES
4.1 Tour prices are based on rates (including foreign exchange rates) known at the time of printing/publishing and are subject to change without notice if such rates change prior to departure.
4.2 In the event of severe currency fluctuation, increase in fuel costs or tariff rates, or other external factors beyond our control, we reserve the right to impose surcharges on the cost of the trip. If increases are greater than 5% you will be informed and may choose to cancel your trip within 7 days of notification and be entitled to a full refund of any monies paid.
5. TOUR BOOKING FORM
5.1 The Booking Form must be fully completed, signed and submitted with deposit payment and correct passport names. Nariku Travel Experiences will not be responsible for any errors as a result of misspelled names on the form.
5.2 Final documents will not be issued until the Booking Form is received.
5.3 A signed Booking Form is an acceptance of the tour program and rate, and acceptance of the Terms and Conditions.
6. INSURANCE
6.1 As a condition of booking, you are required to obtain coverage for personal accident and medical expenses, including repatriation, and you are strongly advised to include coverage for cancellation, curtailment and loss of property. Basic travel insurance is included on some group itineraries, to include Post Departure Trip Protection for missed connection, itinerary change, and trip delay; Medical Protection for emergency accident and sickness, dental, emergency evacuation, medical repatriation and repatriation of remains; Baggage Protection for loss or delay of bags; Travel Accident Protection includes accidental death and dismemberment. Policy upgrades to basic policy are available, including coverage for trip cancellation or interruption prior to trip departure or during the tour.
6.2 The carriage and storage of all baggage and personal effects are at all times the clients’ risk and Nariku Travel Experiences will not accept any liability for loss or damage of baggage or personal effects.
7. ACCEPTABLE FORMS OF PAYMENT
7.1 Checks, Wire Transfer, Visa, MasterCard, PayPal
7.2 Delayed payments without advance notice may result in tour cancellation, and related cancellation fees.
8. VISA & PASSPORT
8.1 A valid passport is required for all travelers. It must be valid six months.
8.2 Visas are required for some destinations, which are to be obtained before departure where possible. Visa requirements are subject to change without notice.
8.3 Securing a visa is the responsibility of each traveler. Nariku Travel Experiences and its agents cannot be held responsible if visa requirements are not fulfilled.
9. ACCOMMODATIONS
9.1 Accommodations are booked as stated in the trip plan, with single rooms subject to a supplemental charge.
10. BAGGAGE ALLOWANCE
10.1 Contact your international airline carrier for baggage restrictions, and confirm any domestic flight baggage allowances, including regional flights booked with Nariku Travel Experiences.
11. TOUR MEMBERSHIP
11.1 Nariku Travel Experiences leaders and guides are there to ensure your trip runs a smoothly as possible and will at all times act in the best interests of the group. If the behavior of any participant jeopardizes the safety and well-being of the group, the leader or other company representative may ask the member to leave without refund. By signing the Booking Form you accept the leader's authority to make such decisions affecting the group and individuals.
12. HEALTH REQUIREMENTS
12.1 Travelers must be in general good health. Nariku Travel Experiences and associated companies reserve the right to disqualify a participant at any time, if in their sole judgment, a participant is not deemed to be medically fit for travel. Such entities assume no liability regarding provision of medical care or any special medical attention. Therefore, it is imperative that persons with medical problems make them known to Nariku Travel Experiences as soon as possible prior to departure.
12.2 Pregnant travelers must notify Nariku Travel Experiences of their ability to travel, and submit a physician statement stating they are allowed to travel. Nariku Travel Experiences will not accept passengers past their fifth month of pregnancy. Passengers who fail to notify Nariku Travel Experiences of pregnancy will be subject to cancellation penalties.
12.3 It is each traveler’s responsibility to check with their medical provider, health board, or Center for Disease Control for specific health requirements.
13. TRAVEL DESTINATIONS
13.1 Although most travel is completed without incident, some destinations may involve greater risk than others. Nariku Travel Experiences urges passengers to review travel prohibitions, warnings, announcements and advisories issued by official Government sources prior to booking travel.
13.2 By offering for sale travel to international destinations, Nariku Travel Experiences does not represent or warrant that travel to such points is advisable or without risk and is not liable for damages or losses resulting from travel to such destinations.
14. EXCLUSIONS
14.1 Expenses and terms not mentioned are not covered, including but not limited to: passport, visa, immunization charges, meals other than stated, beverages, laundry, personal items such as baggage handling and transportation to hometown airports from gateways listed, gratuities to guides, drivers, or departure taxes.
15. CLAIMS, COMPLAINTS & REFUND POLICY
15.1 Except for verifiable extenuating circumstances, there are no refunds, for unused tour services including but not limited to accommodations, meals, internal flights or sightseeing. Any refunds shall be issued in the sole discretion of Nariku Travel Experiences, and based on the actual cost of the service involved.
15.2 Complaints should first be addressed with the trip leader or company representative during the trip to attempt resolution. Further complaints must be made in writing to Nariku Travel Experiences within 14 days after the end of the trip.
15.3 The California Seller of Travel Act provides protections to consumers. If you are located in California and purchase from a registered seller of travel in California, and you do not receive what you have paid for, you can file a claim with the Travel Consumer Restitution Corporation (TCRC). The restitution fund pays on claims arising from the seller's failure to provide contracted goods and services owing to its own wrongful taking of your payment, bankruptcy filing, or closure of business. It does not cover the cessation of an air or sea carrier or a failure by another registered seller to which your funds are forwarded.
16. USE OF PHOTOGRAPHY
16.1 Nariku Travel Experiences and associated companies reserve the right to take photographs during the tour to use for promotional purposes. By reserving a tour with Nariku Travel Experiences, participants agree to allow their images to be used.
16.2 If a participant does not wish to allow his or her image to be used, he or she must advise the guide/escort at the commencement of the tour.
17. RESPONSIBILITY
17.1. Nariku Travel Experiences, its affiliates and related persons act as agents for hotels, airlines, bus companies, railroads and those providing accommodation, transportation, meals, tours, sightseeing and other services. All vouchers, contracts and tickets issued by Nariku Travel Experiences or its agents are subject to current tariffs, terms and conditions under which the services are provided by these companies.
17.2 Nariku Travel Experiences cannot be held responsible for additional costs incurred by the traveler due to missed, cancelled or delayed flights. These costs will be borne by the traveler. By the acceptance of vouchers, contracts or tickets, the traveler agrees to this release of liability for loss, injury or damage of person, property or otherwise in connection with and accommodations, transportation or other services, resulting directly or indirectly from acts of God, dangers incident to remote areas, the sea, machinery, actual or intended wars, whether declared or not, hostilities, civil disturbances, strikes, riots, thefts, sickness, quarantines, medical or custom regulations, defaults, delays or cancellation or changes in itinerary, from causes beyond control of Nariku Travel Experiences.
17.3 Anyone not utilizing the pre-arranged transportation is responsible for the cost of any substitute transportation.
17.4 No change in the itineraries is expected, however due to the nature of international travel, Nariku Travel Experiences reserves the right to make changes if necessary due to unforeseen circumstances in weather and transportation schedules. Nariku Travel Experiences cannot be responsible for changes of itinerary.
17.5 Nariku Travel Experiences reserves the right to cancel all or part of a trip. After refunding all partial and full payments, Nariku Travel Experiences has no other obligations to travelers on canceled trips.
17.6 Nariku Travel Experiences reserves the right to employ subcontractors to carry out all or any part of the services supplied, and extends the clauses relating to the company’s liability to them as well in delivery of services on their behalf.
17.7 Any action by airlines is entirely beyond the control of Nariku Travel Experiences.
17.8 Airlines are not responsible for any act, omission or event during the time the passengers are not aboard their conveyance. The passenger contract issued by the airline shall constitute the sole contract between the airline and the traveler.
18. DISCLOSURE NOTICE
18.1 During your participation in a Nariku Travel Experiences tour certain risks and dangers may arise, including, but not limited to, the hazards of traveling in undeveloped areas, travel by boat, train, automobile, aircraft or other means of conveyance, the forces of nature, political unrest and accident or illness in remote regions without means of rapid evacuation or medical facilities, loss of property, inconvenience, delays and discomfort. Nariku Travel Experiences will not have liability for provisions of medical care or the adequacy of any care that may be rendered.
You are voluntarily participating in these activities with the knowledge of the dangers involved and herby agree to accept any risks.
19. AS LAWFUL CONSIDERATION for the agreement with Nariku Travel Experiences to participate in tours and activities you hereby agree that you will not make a claim against Nariku Travel Experiences or sue for bodily injury, emotional trauma, death and/or property damage, however caused, as a result of your participation. You release Nariku Travel Experiences and its vendors from all claims, actions, and demands for bodily injury, death or property damage arising from your participation. This release of Liability and Assumption of Risk agreement is entered into on behalf of all members of your family including minors accompanying you. This agreement is binding on your heirs, legal representatives and assigns. If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect.
